This is only a child-friendly version of our main Terms of Service. Please read the main Terms of Service for more details. In the event of conflicts between this version and the main Terms of Service the latter shall prevail.

This terms of service applies to our Apps - Everyday Mental Health by Wysa mobile App (“Waitlist App”), Digital Referral Assistant application (“DRA" or "Referral web widget”) and Therapist Companion ("Co-Pilot"). The main Terms of Service and this child-friendly version are a legal agreement between you and us (“Wysa”).If you are under the age of 16, you have read the main Terms of Service with your parents or legal guardian and agree to it.


Services We Offer

One or more services may be provided on behalf of your Institution

  • DRA: Submit a referral for talking therapy services.
  • AI Coach: Chat with an artificial intelligent system.
  • Digital Tools: Resources to help with your feelings and well-being.
  • CYP referrals: Get additional help from your Institution (eg. for CYP users).
  • CCBT: Mental health and well-being computerized CBT programmes.
  • Therapist Companion (TC or Co-Pilot): Connect with your Institution assigned clinician.
  • Data Integration: Receive and share your data with Institutions for providing care.
  • (Coming soon) Wysa+: A new version of the AI Coach using Generative AI.

Important Notes

  • If you are having a serious physical or mental health emergency, stop using the App and call for help immediately.
  • You should be the right age to use the App. Only for ages allowed by your Institution.
  • Do not share personal information unless asked for providing our services.
  • We will receive and share data about you with providers authorised by your Institution and/or opted by you.
  • The AI Coach is not a real person and is restricted in its means of responses.
  • The AI coach cannot give you medical or professional advice.
  • Only use the Apps for general mental health and well-being purposes. Not for severe or enduring physical or mental health conditions.
  • If you have health problems, check with your clinician before using the apps.

About our Apps

With the apps, you can chat with an artificial intelligence (AI) coach to get access to tools and techniques to help manage your emotions and support your mental and behavioural health and well-being.

Intended Use of Our Apps

DRA:The DRA is an AI enabled conversational agent software designed to support client services (“Institution”) that offer and/or provide mental health care. The DRA collects and transfers a range of demographic and screening information, as defined and agreed by the client service, to Electronic Patient Record (EPR) systems for review by the client service clinician. The DRA software uses transparent conditional logic to minimise the question flow for individual users and surface flags to indicate priority areas for client service clinician attention. The DRA software is intended for use in adults age 16 or older and does not suggest potential diagnoses or replace clinical judgement.

Waitlist App:The Waitlist App is an AI-driven conversational agent intended to assist individuals with subclinical or clinical symptoms of anxiety or low mood in managing emotional distress through evidence based techniques such as CBT, goal setting and emotional acceptance. The Waitlist software provides feedback and personalised insights based on user-input data and helps users set meaningful personal goals and take actionable steps towards positive change. It is intended for use by individuals over the age of 13 (or 11+ if agreed by the provider) as a stand alone support tool or in conjunction with regular physical or mental health focussed clinical care (during waiting periods, between appointments, and/or as an adjunct to individual or group therapy). It is not a substitute for professional medical advice, and does not provide medical advice or diagnoses. It is not recommended for use in crisis situations, nor is it suitable for use by those with severe and enduring mental health problems.

Who can Use our app

  • Age Limit: Only for ages allowed by your Institution. Wysa is not responsible if you are using the apps under the specified minimum age requirement.
  • Parents Help: If you are under the age of 16, seek your parent or guardian help to read our main Terms of Service.
  • License: You can use the App for personal use only. We can take away this permission anytime if we notice any misuse.

Where required to create a Wysa account, you will need to provide accurate information and keep your password secure.


Use of DRA Service

When you use our DRA service, are agreeing to the following rules:

  • The DRA service is provided on behalf of your Institution.
  • You can only access the DRA from your Institution’s website or from a QR code provided.
  • This service is not for face-to-face therapy, and it does not give you a diagnosis or medical advice.
  • If you have an emergency, please call local emergency services right away.
  • Where needed, We will receive or share your information with the Institution EPR System.
  • Where authorised, We will share your information with the Institution authorised service providers.
  • Your information will be deleted from our systems after the agreed time with your Institution.
  • Once you send your information, you cannot get it back or change it. For any changes, please talk to your Institution.
  • The app connects you to the Institutional service, but we cannot promise that:
    • The app will always work perfectly.
    • You will always be able to assess the Institution’s website for DRA.
    • Your Institution EPR system will always be available.
    • Your Institution service provider systems will always be available.
    • Your information will always be successfully sent and received by your Institution.
    • You will always get confirmation of appointments with your Clinician about therapy.
  • You are responsible for what you submit when using the service.
  • You might losse access to the DRA if our contarct with your institution ends.


Use of Wysa CCBT and Therapist Companion Service

Note: This service is currently available only for research and clinical investigation purposes.

When you use our CCBT and Therapist Companion service, you are agreeing to the following rules:

  • This service connects you with clinicians chosen by your institution.
  • It is not for emergencies. Contact local emergency services if needed.
  • Your chat with the AI Coach can be seen by your clinician. You can opt out anytime from app settings.
  • Clinicians will monitor your use of the CCBT programmes and take notes.
  • The CCBT programmes are an alternative to face-to-face therapy however they are only supportive resources.
  • Clinicians will provide information and resources for your mental well-being and care.
  • Your data is shared with your Institution for better care.
  • The app connects you to the Institutional service and their clinician, but we cannot promise that:
    • The app will always work perfectly.
    • The Clinician will always be willing or able to listen.
    • The Clinician’s advice will always be relevant, useful, accurate, or satisfactory.
    • The Clinician’s advice will be safe or suitable for you.


Use of Wysa+ Service

When you use our Wysa+ service, you are agreeing to the following rules:

  • You must be old enough as approved by your institution to use Wysa+.
  • Wysa+ might not work when:
    • Your messages do not clear our safety checks.
    • The Gen AI does not clear safety checks.
    • The Gen AI is not working.
  • Wysa+ might not always work perfectly. This means:
    • Do not share your or anyone else's private details if not asked.
    • The Gen AI might give you wrong or made-up answers.
    • You might get incorrect tool suggestions if the Gen AI does not understand you.
    • The Gen AI could misinterpret certain words, especially medical terms.
  • You can take the following safeguards:
    • Do not share any sensitive information about yourself or others.
    • Do not write meaningless text.
    • Do not type anything that could be harmful or unsafe.
  • Wysa is committed to being responsible and protecting your rights while using the Gen AI.


Additional Terms

  • We might link with your Institution's or their service provider systems to share your information safely.
  • Wysa is not responsible if there are mistakes or missing information in your submissions.
  • You have rights about your data. Check our Privacy Policy for more.
  • We use some anonymous data to make our service better.
  • If you join any research studies or testing initiatives, we will collect your information with your permission. Read the main Terms of Service for more details.
  • Our apps depend on technology and the internet. We cannot promise the app will always work perfectly.
  • Our app might link to other websites. We do not control or take responsibility for them. We suggest checking their notices before using them.
  • The potential risks inherent to AI technology may not be fully understood and fulsome safeguards may not be fully developed.
  • Use strong device passwords and keep your device safe from others. Wysa is not responsible if someone else sees your information.


Your Conduct during use

  • Do not knowingly or recklessly engage in wrongful activities.
  • Do not share personal data without permission.
  • Be respectful in your interactions.


User Content

  • Anything you share remains yours.
  • We can view or share what you post to help provide our services.
  • Do not post harmful, illegal, or inappropriate content.

Mobile Software

  • Keep your app updated for the best experience.
  • Follow secure practices for sharing and using the app on your device.

No Professional Advice

  • The app provides general advice only. Always consult a professional for medical or legal advice.

Monitoring and Safety

  • We may monitor the content on the App to keep you safe.
  • Unauthorized use of the app will be monitored and may be reported to your Institution.

Termination

  • We can stop your access to Wysa at any time if you do not follow the agreement terms.

Indemnity and Warranty

  • You agree to protect Wysa from any harm or legal issues that arise from misuse.
  • Wysa services are provided "as is" and may have limitations.

Limitations of Liability

  • We are not responsible for any harm that may happen, not caused by us, from your using the app and services.
  • We comply with laws in India, the UK, and the USA, but check local laws if you are in another country.

Governing Law

  • Any legal issues will be dealt with in the appropriate courts and as per applicable laws of England and Wales.

Changes to Terms

  • These terms can change, so check back your App regularly.
  • Continuing to use Wysa means you agree to the updated terms.
  • Read the changes in our main Terms of Service.
